These Terms of Use ("Terms") govern your access to and use of Rehearsal Assistant and related services (collectively, the "Services") provided by Database Apps, LLC ("Company," "we," "us," or "our").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. DESCRIPTION OF SERVICES

Rehearsal Assistant is a communication, scheduling, and organizational management platform designed to assist music organizations, performing arts groups, and other organizations in coordinating activities, events, rehearsals, performances, volunteer opportunities, and related communications.

We reserve the right to modify, suspend, or discontinue any feature of the Services at any time.

2. ELIGIBILITY

You must be at least 13 years old to use the Services.

If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Services.

By using the Services, you represent that you have the legal authority to enter into these Terms.

3. USER ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

Provide accurate and current information.

Maintain the security of your account.

Promptly update information that becomes inaccurate.

Notify us of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

4. ORGANIZATION RESPONSIBILITIES

Organizations using Rehearsal Assistant are solely responsible for the information they provide through the Services, including but not limited to:

Rehearsal schedules

Performance schedules

Event information

Volunteer assignments

Member contact information

Announcements and communications

Database Apps, LLC does not verify the accuracy of information submitted by organizations or users and is not responsible for errors, omissions, or outdated information.

5. COMMUNICATIONS

Email Communications

By creating an account, you agree to receive service-related communications necessary for the operation of the Services.

SMS Communications

Users may choose to opt in to receive SMS (text message) notifications.

By opting in, you consent to receive text messages regarding organization activities, schedules, reminders, announcements, volunteer opportunities, and other service-related communications.

Message frequency varies.

Message and data rates may apply.

You may opt out of SMS communications at any time by replying STOP to any text message.

For assistance, reply HELP or contact support@dbapps.net.

Consent to receive SMS messages is not required to use the Services.

Supported carriers are not responsible for delayed or undelivered messages.

6. ACCEPTABLE USE

You agree not to:

Use the Services for unlawful purposes.

Attempt to gain unauthorized access to accounts, systems, or data.

Upload or distribute malicious software.

Interfere with the operation or security of the Services.

Impersonate another person or organization.

Use the Services to transmit spam or unauthorized communications.

Violate applicable laws or regulations.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. USER CONTENT

You retain ownership of content that you submit to the Services.

By submitting content through the Services, you grant Database Apps, LLC a limited license to store, process, display, and transmit that content solely for the purpose of providing the Services.

You represent that you have the necessary rights and permissions to submit any content you provide.

8. INTELLECTUAL PROPERTY

Rehearsal Assistant, including its software, design, functionality, trademarks, logos, and related content, is owned by Database Apps, LLC and protected by applicable intellectual property laws.

Except as expressly permitted, you may not:

Reverse engineer

Distribute

Sell

License

any portion of the Services without prior written permission.

9. SERVICE AVAILABILITY

The Services are provided on an "as available" and "as is" basis.

We do not guarantee:

Continuous availability

Uninterrupted service

Error-free operation

Delivery of notifications

Compatibility with all devices or networks

Service interruptions may occur due to maintenance, software updates, third-party providers, internet outages, cellular carrier issues, or circumstances beyond our control.

10. IMPORTANT NOTIFICATION DISCLAIMER

Rehearsal Assistant serves as a communication and scheduling platform.

Database Apps, LLC does not guarantee that notifications, emails, text messages, reminders, schedules, or announcements will be delivered, received, or viewed by users.

Users and organizations remain responsible for verifying important schedules, performances, rehearsals, volunteer assignments, deadlines, and event information.

Database Apps, LLC is not responsible for missed rehearsals, performances, volunteer assignments, scheduling conflicts, or other consequences resulting from delayed, undelivered, inaccurate, or overlooked communications.

11. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services are provided without warranties of any kind, whether express or implied.

We disclaim all warranties including, but not limited to:

Merchantability

Fitness for a particular purpose

Non-infringement

Accuracy

Reliability

Availability

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Database Apps, LLC, its officers, employees, contractors, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

Use of the Services

Inability to use the Services

Loss of data

Missed notifications

Missed rehearsals or performances

Scheduling conflicts

Service interruptions

Third-party service failures

In no event shall our total liability exceed the amount paid by you, if any, for use of the Services during the twelve (12) months preceding the claim.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Database Apps, LLC and its affiliates from any claims, damages, liabilities, costs, or expenses arising from:

Your use of the Services

Your violation of these Terms

Content submitted by you

Your violation of any law or third-party rights

14. TERMINATION

We may suspend or terminate your access to the Services at any time if:

You violate these Terms.

We believe your actions may harm the Services or other users.

We are required to do so by law.

You may discontinue use of the Services at any time.

15. CHANGES TO THESE TERMS

We may modify these Terms from time to time.

Updated Terms become effective when posted within the Services or on our website.
